AGFConnect Terms & Conditions

By purchasing, installing, accessing, or using the AGFConnect™ system, including associated sensors, gateways, software, and cloud services (collectively, the “System”), you agree to the following Terms and Conditions of Use.

  1. Intended Use

    1. AGFConnect™ is designed to monitor components on fire sprinkler systems and to provide alerts based on sensor data. The System is intended as a supplemental monitoring tool only and is not a replacement for required inspections, testing, or maintenance of fire protection systems.

  2. User Responsibility

    1. The owner, facility manager, contractor, or other party using the System (“User”) is solely responsible for:

      1. Proper installation, configuration, and testing of the System

      2. Ongoing inspection, maintenance, and operation of the fire sprinkler system

      3. Routine draining of the fire sprinkler system as required

      4. Ensuring all devices remain powered, connected, and functioning properly

      5. Maintaining active service subscriptions and renewals is required for monitoring and alert functionality

    2. Failure to maintain any of the above may result in loss of monitoring capability or failure to receive alerts.

  1. No Guarantee of Performance

    1. AGF Manufacturing Inc. (“AGF”) does not guarantee that the System will:

      1. Detect all instances that require notification

      2. Transmit data or alerts without interruption

      3. Operate without error, delay, or failure

    2. System performance may be affected by environmental conditions, building construction, signal interference, power availability, cellular network performance, or improper installation.

  1. Not a Life Safety System

    1. AGFConnect™ is not a life safety system and is not intended to replace code-required fire protection devices, alarms, or monitoring services. The System should not be relied upon as the sole means of preventing property damage, system failure, or personal injury.

  2. Limitation of Liability

    1. To the fullest extent permitted by law, AGF shall not be liable for any direct, indirect, incidental, special, or punitive damages, arising out of or related to the use, misuse, or inability to use the System, even if AGF has been advised of the possibility of such damages, including but not limited to:

      1. Property damage

      2. Water damage or freeze-related system failure

      3. Loss of business or revenue

      4. Service interruptions

      5. Personal injury or death

  1. Assumption of Risk

    1. Users acknowledge that monitoring auxiliary drains in dry fire sprinkler systems involves inherent risks, particularly in freezing conditions. User assumes all risks associated with the use of the System and agrees that AGF is not responsible for outcomes related to system performance or failure.

  2. Service & Connectivity

    1. The System relies on third-party services, including but not limited to cellular networks, Ethernet connections, and cloud platforms. AGF is not responsible for:

      1. Service outages or interruptions

      2. Data transmission failures

      3. Changes in third-party service availability

    2. An active subscription may be required for full functionality. It is the User’s responsibility to maintain all required service agreements.

  1. Indemnification

    1. User agrees to indemnify, defend, and hold harmless AGF, its affiliates, employees, and representatives from and against any claims, damages, losses, or expenses arising from:

      1. Improper installation or use of the System

      2. Failure to maintain the fire sprinkler system

      3. Failure to maintain active monitoring services

      4. Any breach of these Terms and Conditions

  1. Modifications

    1. AGF reserves the right to modify these Terms and Conditions at any time. Continued use of the System constitutes acceptance of any updated terms.

  2. Governing Law

    1. These Terms and Conditions shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles.

  3. Acceptance

    1. By using AGFConnect™, User acknowledges that they have read, understood, and agree to be bound by these Terms and Conditions.
